1. Introduction

BS Money ("BS Money", "us", "we", or "our") is committed to maintaining the confidentiality, integrity and security of any personal information of our users. This Privacy Policy ("Policy") applies to those who download and use our mobile application ("App"), as well as users of our platform, tools and services offered by BS Money ("Service"). By downloading or using the App, you agree to and accept the terms of use governing your use of the App and/or utilizing any Services offered by BS Money, which may be amended from time to time by us.

2. Definitions

In this Policy: (i) capitalised terms defined by inclusion in quotations and / or parenthesis have the meanings so ascribed; and (ii) the following terms shall have the following meanings assigned to them herein below:
"Applicable Law" includes all applicable Indian statutes, enactments, acts of the state legislature or parliament, laws, ordinances, rules, bye-laws, regulations, notifications, guidelines, directions, directives and orders of any governmental authority, statutory authority, board, recognised stock exchange, as may be applicable including but not limited to Guidelines on Managing Risks and Code of Conduct in Outsourcing of Financial Services by Banks, Business Correspondent Guidelines issued by RBI from time to time, Payment & Settlement Systems Act, 2007, Payment & Settlement Systems Regulations, 2008, Policy Guidelines on Issuance and operation of Pre-paid Payment Instruments in India, Aadhaar act and any other guideline issued from time to time by Reserve Bank of India and in each case, any implementing regulation or interpretation issued thereunder including any successor Applicable Law;

"Company" / "Us" / "We" / "Our" shall mean BS Money (which expression shall, unless it be repugnant to the context or meaning thereof, be deemed to mean and include its successors and permitted assigns);
"Personal Information" shall mean any personally identifiable information provided to Us by a User for creation of a BS Money Account or availing Services through the App; "Services" shall mean the services provided by Company through its Platform;
"User" / "You" / "Your"; shall mean any natural or legal person who has access to and is using the App; and "App" / "Platform" shall mean the BS Money Android application, any successor apps, or any other channel facilitated and permitted by the Company.

3. Information Collection and Use

a) We may collect Your Personal Information when you successfully submit information while creating Your BS Money Account on the App ("User Information"). User Information is the data that can be used to uniquely identify or contact a person and/or the business entity that a person represents and shall include, but not be limited to, Your Information including Accounts/Contacts details, device Information, Camera & Media and your Location and such other information for the purposes of identification and verification.
b) Without prejudice to the generality of paragraph (a) above, We may request such additional User Information as may be required for accessing and availing any Services through the App.
c) By creating a BS Money Account and by accessing Services, You authorize Us to collect, store, process, handle and use such User Information, in accordance with this Policy.
d) Personal Information provided by You is used by Us to improve the App and/or Service. We do not share Your Personal Information with any third parties for commercial use or revenue generation.
e) We may share Personal Information such as your name, mobile number and email address with third party service providers appointed by us to send SMS / Email communications to you in relation to the App and/or Services. We ensure that such third party service providers maintain strict confidentiality of Your Personal Information.

4. Log Files

We may use IP addresses to analyse usage, administer our site/app, and gather demographic information for aggregate use.

5. Accuracy and Completeness of Information

a) You represent and warrant that You shall be responsible for accuracy and correctness of all User Information provided by You for creation of a BS Money Account and for accessing any Services available on the App.
b) For compliance with Applicable Law including but not limited to e-KYC requirements, You may be required to submit such personal identification documents as may be required by Us from time to time.

6. Representations and Warranties

a) By creating a BS Money Account and accessing Services on the App, You represent that You are at least the age of majority in Your state or province of residence.
b) You shall not, in the use of the Service, violate any Applicable Laws in Your jurisdiction.
c) You also acknowledge that the use of the App requires internet and/or mobile connectivity. You shall bear the costs incurred to access and use the App and We shall not, under any circumstances whatsoever, be responsible or liable for such costs.
d) You shall be solely responsible for all activities undertaken through Your BS Money Account,
whether or not you have authorized such activities or actions.

7. Third Parties and Retention of Information

a) We may allow You to access certain Services provided by third-party service providers, which we neither monitor nor exercise any control over.
b) We may engage other companies and individuals to perform functions on our behalf & such third parties may be provided with the information described above.
c) You acknowledge and agree that we provide access to such third-party Services on an "as is" basis and "as available".

8. Intellectual Property & Indemnification

All rights, title, and interest in the App including content, design, and features belong to BS Money. Unauthorized use is prohibited. You agree to indemnify and hold BS Money harmless from any claims arising from misuse of the App or violation of this Policy.

9. Protection of Your Information & Removal

a) We implement appropriate security measures to protect your data. However, no platform is completely risk-free.
b) Upon deletion of your BS Money Account, we will remove User Information stored with us within 3 (three) months, subject to legal and regulatory requirements.

10. Links

The App may contain links to or from other websites. We are not responsible for the privacy practices of other websites. This Privacy Policy applies only to the information we collect on this App.

11. Notification of Changes

We reserve the right to update this Policy at any time. Changes will be posted in the App and will be effective immediately. Continued use of the App constitutes your acceptance of the updated Policy.

12. Comments and Grievances

If you have any questions, comments, or concerns about our privacy practices, please contact our grievance officer through e-mail at info@advitacredit.in. Your grievances will be redressed within the time period prescribed under applicable law.
